According to reports, " The Measures are applicable to the concealment and false reporting of production safety accidents in various industries within their respective administrative areas accepted by the departments responsible for safety production supervision of the governments at or above the county level (pilot area management committees) in our city (hereinafter referred to as "departments responsible for safety supervision"), Verification, supervision, transfer, feedback and reward of illegal acts of production safety and reports of major accidents. Other departments responsible for safety supervision have other provisions on safety production reporting rewards in the supervised industries, in accordance with their provisions.
The "Measures" stipulate that any unit, organization or individual (hereinafter referred to as "whistleblower") has the right to report to the department responsible for safety supervision for concealing and falsely reporting production safety accidents, illegal and illegal acts of production safety and major hidden dangers of accidents in the field of production safety. Safety production reporting rewards follow the principles of "legal reporting, appropriate rewards, graded acceptance, territoriality first" and "who checks, who rewards", and the departments responsible for safety supervision carry out safety production reporting rewards in this industry.
Departments responsible for safety supervision shall establish and improve relevant systems such as acceptance, verification, handling, coordination, supervision, transfer, reply, reward, statistics and reporting of major accidents and illegal acts reported by their own departments. And specify the internal institutions responsible for handling the report of production safety, and publish the office telephone number, e-mail and other contact information of the institutions handling the report on the official website.
The term "production safety accident concealment behavior" as mentioned in the Measures refers to concealing the accident that has occurred, failing to report to the department responsible for safety supervision within the prescribed time limit, and being verified by the report.
"False reporting of production safety accidents" refers to deliberately failing to truthfully report the time, place, preliminary cause, nature, number of casualties and risks, direct economic losses and other relevant contents of the accident, which are verified by the report.
"Illegal production safety" refers to the behavior that citizens, legal persons or other organizations engage in production, operation and construction activities without obtaining the administrative license of the department responsible for safety supervision according to law, or the behavior that citizens, legal persons or other organizations continue to engage in production, operation and construction activities after the administrative license has expired.
"Illegal acts of production safety" refers to the acts of production and business units and their employees engaging in production, business and construction activities in violation of laws, regulations and rules on production safety, mandatory national standards or industry standards.
"Hidden dangers of major accidents" refer to hidden dangers that are difficult to harm and rectify, which should be completely or partially stopped or closed, and can only be eliminated after a certain period of rectification and treatment, or hidden dangers that are difficult to be eliminated by production and business units due to external factors. The judgment of major accident hidden dangers in relevant industries and fields shall be determined according to the judgment standards formulated by the departments responsible for safety supervision.
Informants can report concealed or false production safety accidents, illegal production safety acts and major accident hazards through the "12345" government service convenience hotline, or by means of letters, e-mails, faxes, visits, and special network platforms.
The "Measures" stipulate that if it is verified to be true, the department responsible for safety supervision that accepts the report shall reward the meritorious whistleblower according to the following provisions: those who report concealed or falsely reported production safety accidents shall be rewarded according to the finally confirmed accident level and the verified number of concealed or falsely reported deaths. Among them: General accidents are calculated according to the reward of 30,000 yuan for each verified concealment or false report; Major accidents are calculated according to the reward of 40,000 yuan for each verified concealment or false report; Major accidents are calculated according to the reward of 50,000 yuan for each verified concealment or false report; Particularly serious accidents are calculated according to the reward of 60,000 yuan for each verified concealment or false report. The maximum reward shall not exceed 300,000 yuan.
To report illegal acts of production safety and major accidents, the reward amount shall be calculated according to 15% of the administrative penalty amount, with a minimum reward of 3,000 yuan and a maximum of no more than 300,000 yuan. Administrative punishment shall be implemented in accordance with the Safety Production Law and other laws, regulations and rules and regulations.
If the safety production report of employees in production and business units accepted is verified, the reward standard shall be determined according to the proportion of 20% increase on the basis of the provisions of this Article, and the maximum shall not exceed 360,000 yuan.
The "Measures" require that for informants who meet the reward conditions, the departments responsible for safety supervision should promptly notify them to go through the formalities of receiving bonuses. After receiving the notice of receiving the bonus, the whistleblower shall submit his ID card, bank card number and other relevant information to the designated place within 60 days; If the informant cannot be notified, the department responsible for safety supervision that accepts the report may make an announcement within a certain scope. Failure to submit materials related to receiving bonuses within the time limit shall be deemed as giving up the right to receive awards; If the reasons can be explained, the collection time can be appropriately extended, but the longest period shall not exceed 30 days. The department responsible for safety supervision that accepts the report shall, within 10 working days after receiving the procedures for receiving the bonus from the whistleblower, issue the bonus to the whistleblower.
