In order to deepen the reform of 'streamline administration, delegate powers and improved regulation and service' and optimize the business environment, improve the acceptance mechanism of government services and improve the efficiency of examination and approval, the Municipal Business Bureau has drafted the 'Dalian Government Service Shortage Acceptance Measures' (hereinafter referred to as the 'Measures'). The relevant situation is now interpreted as follows:
I. Background of Introduction
In May 2018, the General Office of the CPC Central Committee and the General Office of the State Council, People's Republic of China jointly issued the Guiding Opinions on Further Promoting the Convenience of Examination and Approval Services, promoting facilitation measures such as filling up vacancies, green channels, chief service officers and digital map review, notification of commitments, postal or express delivery, etc. to improve handling efficiency and service level through multiple channels and channels. In July 2019, the General Office of the State Council issued the Guiding Opinions on Accelerating the Construction of Social Credit System and Constructing a New Credit-based Supervision Mechanism, requiring the establishment and improvement of a credit commitment system. If the applicant has a good credit status and some application materials are incomplete but a written promise is made to provide them within the prescribed time limit, it shall be accepted first to speed up the processing progress.
According to the spirit of the above-mentioned documents, the Municipal Business Bureau, in combination with Dalian's actual situation, drafted the 'Measures' after detailed research and demonstration, and carried out procedures such as soliciting opinions and reviewing legality, which were promulgated and implemented after being deliberated and approved by the 74th executive meeting of the municipal government.
II. Main Contents
There are 19 articles in the Measures, which respectively specify the purpose, definition, scope of application, implementation procedures and other matters of implementing the 'Shortage Acceptance' in combination with the 'credit supervision', providing institutional guarantee for government service departments to implement the Shortage Acceptance.
(1) First 'promise' and then 'accept shortage' to promote the speed and efficiency of government services. The Measures clearly state: If the basic conditions are met, the main application materials are complete and conform to the legal form, However, for government services that lack secondary conditions or application materials, After the applicant has made the corresponding commitment, the government service department will accept it first, and inform the materials that need to be corrected, the form of correction, the time limit for correction and the treatment methods for overdue correction at one time on the spot. After the applicant has corrected the materials, the government service department will issue timely opinions on the handling results within the commitment time limit, and issue relevant approval documents and licenses that meet the conditions. This mode breaks the original tradition of 'only when the application materials are complete and conform to the legal form can the government service be accepted', that is, on the premise of not violating the legal principle, it allows 'filling up the materials while accepting the examination', effectively promoting the government service to be more efficient and convenient.
(2) Relying on credit supervision and strengthening system design. The Measures emphasize: First, establish a linkage mechanism between credit supervision and Shortage Acceptance. First of all, Shortage Acceptance is not applicable if the applicant has a record of dishonesty. Secondly, the government service department shall promptly push the information of the dishonest applicant who fails to fulfill the Shortage Acceptance commitment to the municipal credit center and record it in its public credit file. At the same time, the commitment system shall no longer be applied to the applicant for government service matters within six months. The second is to publish the 'Shortage Acceptance Government Service List'. Each government service department shall, according to the actual situation, formulate and publish to the public its 'Shortage Acceptance Government Service List' and implement dynamic management. The list should specify the main application materials and secondary application materials; The third is to broaden the channels of correction. The applicant may supplement the Shortage Acceptance materials through postal delivery and other means approved by the government service department.
(3) Strengthen safeguard measures to ensure effective implementation. The 'Measures' stipulate that the management agencies of government service centers at all levels and types shall supervise the Shortage Acceptance carried out by government service departments according to their management authority and division of responsibilities, and regularly organize and carry out special supervision on the implementation of the Shortage Acceptance system. And can entrust a third-party evaluation agency to carry out Shortage Acceptance work evaluation.
