The people's governments of all districts, cities and counties, the administrative committees of all pilot districts, all commissions and bureaus of the municipal government, all institutions directly under the municipal government, and all relevant units:

 

In order to thoroughly implement the spirit of the Implementation Opinions of Liaoning Provincial People's Government of the CPC Liaoning Provincial Committee on Promoting Reform and Development in the Field of Production Safety' (Liaoning Provincial Party Committee [2017] No.38) and the 'Opinions of Liaoning Provincial People's Government General Office of the CPC Liaoning Provincial Committee on Further Strengthening the Implementation of Supervision Responsibility for Production Safety' (Liaoning Provincial Party Committee [2018] No.108), In combination with the requirements of the Provisions on the Responsibility System for Work Safety of Local Party and Government Leading Cadres (issued by Document No.13 [2018]), and the Provisions on Work Safety Responsibilities of Party Committees, Governments and Relevant Departments at All Levels in Dalian (Trial) (issued by Document No.6 [2018]), the supervision and management responsibilities for work safety of all levels of government and relevant departments will be further implemented in accordance with the principle of 'combining hierarchical management with territorial management and giving priority to territorial management'. To improve the responsibility system for production safety, we hereby notify the following matters concerning further strengthening the implementation of the responsibility for production safety supervision of Dalian municipal governments at all levels and their departments responsible for the supervision and administration of production safety:

 

I. Determination of the scope of municipal direct supervision

 

1. In accordance with the relevant provisions, except for those enterprises whose laws and regulations or higher-level documents have clearly been supervised by the higher-level government and supervised by the central vertical management department, the municipal-level or above (including municipal) state-owned or state-controlled enterprises within the administrative area of Dalian are still under the direct supervision of the municipal-level departments responsible for the supervision and administration of production safety.

 

2 medium-sized or above (including medium-sized) high-risk industry enterprises shall be directly supervised by the municipal departments responsible for the supervision and administration of production safety.

 

II. determination of the scope of supervision at the county level

 

1. The county-level departments responsible for the supervision and administration of production safety shall be responsible for supervising the business outlets (including gas stations) of state-owned or state-controlled enterprises above the municipal level within their respective administrative areas.

 

2. Other high-risk industry enterprises, medium-sized and above other types of enterprises, and county (city, district and pilot area) affiliated enterprises within each administrative region shall be supervised by the departments responsible for the supervision and administration of production safety at the county level, and other enterprises other than the above-mentioned enterprises may be supervised by villages and towns (streets).

 

3. Enterprises other than the above-mentioned enterprises shall be determined by each region according to the principle of territorial supervision in combination with the actual supervision, and the scope of responsibility for graded and classified supervision shall be determined in accordance with the principle of territorial supervision.

 

III. Problems need to be clarify

 

1. All districts, cities and counties (pilot districts) should clearly define the scope of county-level supervision enterprises in combination with the actual situation in the region. Key enterprises within the scope of county-level supervision responsibilities shall, in principle, be directly supervised by the departments responsible for the supervision and administration of production safety at the county level.

 

2. Other enterprises within the administrative area of each district, city and county (pilot district) may entrust villages and towns (streets) to be responsible for supervision, and all relevant departments at the county level shall strengthen the guidance on supervision of villages and towns (streets).

 

3. Full implementation of grid supervision of production safety. Governments at all levels should establish a grid-based supervision system for production safety that extends from counties and townships to communities to achieve full coverage of grass-roots production safety supervision.

 

4. Local governments at or above the county level shall be responsible for the supervision and administration of special equipment safety departments within their respective administrative areas to implement supervision and administration of special equipment safety, and to implement territorial supervision responsibilities.

 

Iv. other matters

 

1. Matters not covered in this notice shall be implemented in accordance with the relevant laws and regulations and the provisions of the municipal government and relevant departments on work safety.

 

2. This notice shall come into force as of the date of issuance. Notice of Dalian Municipal People's Government on Further Implementing the Supervision Responsibility for Work Safety (Dalian Government [2010] No.79) shall be repealed at the same time.
