Measures for Promoting School-enterprise Cooperation of Dalian Vocational Colleges

 

Chapter I General Provisions

 

Article 1 In order to thoroughly implement the spirit of the Nineteenth National Congress of the Communist Party of China and the National Education Conference, promote, standardize and guarantee school-enterprise cooperation in vocational colleges, give full play to the important role of enterprises as the main body of running schools in the implementation of vocational education, we will promote the formation of a common education mechanism featuring integration of industry and education, school-enterprise cooperation, work-study integration and integration of knowledge and practice. We will build a knowledge-based, skilled and innovative workforce, improve the modern vocational education system, in accordance with that Vocational Education Law of the People's Republic of China and the Circular of the State Council on Printing and Distributing the Implementation Plan of the National Vocational Education Reform (Guo Fa (2019) No. 4), Several Opinions of the General Office of the State Council on Deepening the Integration of Industry and Education (Guo Ban Fa (2017) No. 95), and the Circular of the Ministry of Education and Other Six Departments on Printing and Distributing the Measures for Promoting School-enterprise Cooperation in Vocational Schools (Jiao Zhi Cheng (2018) No. 1). These Measures are formulated in light of the actual conditions of this Municipality.

 

Article 2 The term 'school-enterprise cooperation' as mentioned in these Measures refers to the cooperative activities carried out by vocational colleges and enterprises in the course of implementing vocational education by agreeing on the rights and obligations of both parties through agreements and other means, and by means of joint education, cooperative research, joint establishment of institutions and sharing of resources.

 

Article 3 School-enterprise cooperation shall implement a cooperation mechanism of school-enterprise leadership, government promotion, market guidance, industry guidance and school-enterprise dual-subject implementation. Relevant departments of the municipal and county (city and district) governments shall establish and improve the supporting policies, service platforms and guarantee mechanisms for school-enterprise cooperation.

 

Article 4 School-enterprise cooperation shall be carried out on the basis of educating people, fully implement the educational policies of the Party and the State, abide by the principles of equality, voluntariness, shared responsibility, process co-management and achievement sharing, adhere to the implementation of laws and regulations, protect the legitimate rights and interests of all parties to the cooperation, fully mobilize the enthusiasm of both school and enterprise, and realize mutual complementarity of advantages and common development.

 

Article 5 The municipal, county (city, district) educational administrative departments shall, together with the relevant departments at the same level such as human resources, social security and industry supervisors, do a good job of overall coordination, planning guidance, macro-management and service guarantee of school-enterprise cooperation within their respective administrative areas.

 

Development and reform, industry and information technology, finance, natural resources, agriculture and rural areas, commerce, state-owned assets management, taxation and other relevant departments shall do a good job in school-enterprise cooperation according to the division of responsibilities.

 

The competent departments and organizations of the industry shall be responsible for the overall planning, coordination, guidance and promotion of school-enterprise cooperation in the industry.

 

Chapter II Forms and Contents of Cooperation

 

Article 6 Vocational colleges shall incorporate school-enterprise cooperation into their development plans and into the whole process of personnel training, establish school-enterprise cooperation working committees, regularly study major issues of school-enterprise cooperation, and systematically promote school-enterprise cooperation.

 

Article 7 Vocational colleges and universities shall, in accordance with their own characteristics and the needs of personnel training, actively cooperate with enterprises that are legally operated, technologically advanced, standardized in management and meet the requirements of laws and regulations on production safety, and actively provide the enterprises with the necessary technology, information, courses, teachers, training and human resources.

 

Enterprises shall fulfill their obligations to implement vocational education according to law, actively provide information and consulting services to schools, fully utilize capital, technology, knowledge, facilities, equipment and management and other elements to participate in school-enterprise cooperation, and promote human resources development and technological skills inheritance and innovation.

 

Article 8 Vocational colleges, industries and enterprises shall carry out the following cooperation in personnel training, technological innovation, employment and entrepreneurship, social services, cultural heritage, international cooperation and exchange in light of their actual conditions:

 

(1) Predicting the demand for technical and skilled personnel according to the development trend of the regional industry, cooperating in the construction of specialties, jointly developing standards for the cultivation of specialized personnel and professional competence, improving the curriculum system, formulating teaching standards, developing teaching materials, teaching equipment and auxiliary supplies, etc.;

 

(2) Cooperate in formulating personnel training or staff training programs, so as to realize that personnel can work part-time for each other and provide mutual support for students' practical training, teachers' practice, students' employment and entrepreneurship, professional ability appraisal, staff training, enterprise technology and product research and development, and achievement transfer and transformation, etc.;

 

(3) To implement the modern apprenticeship system and the new apprenticeship system in enterprises according to the job requirements of enterprises, to recruit students jointly, and to carry out the dual-subject education of schools and enterprises according to the work-study combination mode;

 

(4) Cooperating in running schools in various forms, establishing and jointly managing teaching and scientific research institutions, building practice and training bases, technological process and product development centers, as well as institutions for students' innovation and entrepreneurship, staff training and skills appraisal;

 

(5) Cooperating in research and development of job specifications, quality standards and product standards, and participating in or leading the formulation of industry standards;

 

(6) Organizing and carrying out activities such as vocational skills competitions, the construction of enterprises integrating industry with education, the inheritance of excellent corporate culture and social services;

 

(7) Joint international cooperation and exchange;

 

(8) Other forms and contents of cooperation permitted by laws and regulations.

 

Article 9 Vocational colleges and enterprises shall, in accordance with the regional industrial plan, the development of colleges and universities and the needs of industrial enterprises, formulate cooperative plans, establish educational and teaching organization and management systems suitable for carrying out school-enterprise cooperation, clarify relevant institutions and personnel, reform teaching contents and methods, and improve the quality evaluation system.

 

Article 10 Vocational colleges and enterprises shall, in carrying out cooperation, sign cooperation agreements through consultation on an equal footing in accordance with the law and regulations. The cooperation agreement shall clearly stipulate the objectives, tasks, contents, forms, rights and obligations and other necessary matters of the cooperation, and reasonably determine the time limit for the implementation of the agreement according to the contents of the cooperation. Where an enterprise accepts interns, the time limit for the cooperation shall be not less than three years.

 

Article 11 Encourage qualified enterprises to establish or participate in the establishment of vocational colleges, secondary colleges, skill master studios, training centers and teaching factories, and provide students with internships, apprenticeships and teachers with practical positions; Enterprises above the designated size are encouraged to set up staff training and continuing education institutions in vocational colleges. The learning results of the training and continuing education of enterprise staff and workers may be recognized and linked up with the education of vocational colleges in accordance with the relevant provisions and methods. The situation of school-enterprise cooperation should be included in the corporate social responsibility report.

 

Article12 The competent department of vocational colleges shall, together with relevant department and trade organizations, encourage and support vocational colleges and relevant enterprises to establish long-term and stable cooperative relationship by forming vocational education groups and school-enterprise cooperative alliances. Encourage vocational education groups to operate substantively, carry out pilot projects in which multiple investors jointly build vocational education groups with corporate status, and explore the establishment of a governance structure for vocational education groups based on the property rights system and market mechanism.

 

The vocational education group or school-enterprise cooperation alliance shall stipulate the mode, content, rights and obligations of cooperation among the group or alliance members in the form of articles of association or multi-party agreement.

 

Article 13 Vocational colleges and enterprises shall establish a process management and performance evaluation system for school-enterprise cooperation, regularly sum up the results of cooperation, innovate the forms of cooperation, expand the areas of cooperation and raise the level of cooperation.

 

Chapter III Promoting Policies and Measures

 

Article 14 To establish a coordination mechanism involving the relevant departments of education, development and reform, industry and information technology, finance, human resources and social security, natural resources, agriculture and rural areas, commerce, management of state-owned assets, and taxation, and to study and solve major problems in school-enterprise cooperation in vocational education.

 

Article 15 When formulating industrial development plans, industrial incentive policies and trans-regional cooperation plans, the relevant departments of the municipal or county (district or city) government shall regard promoting the participation of enterprises in school-enterprise cooperation and training technical skilled personnel as important contents, and strengthen the guidance, support and service for school-enterprise cooperation and training technical skilled personnel.

 

The competent departments and organizations of the industry shall, according to the characteristics and development needs of the industry, organize and guide the enterprises to put forward the intention or plan of school-enterprise cooperation, coordinate and link up with relevant plans, participate in the performance evaluation of school-enterprise cooperation, and provide corresponding support and services. Strengthen the construction of municipal industry teaching steering committee, improve the prediction mechanism of industry human resource demand, regularly issue the prediction report of industry market demand for talents, carry out the construction of the standard system of professional ability, professional teaching and curriculum, and participate in the process guidance of professional personnel training and technical skills inheritance and innovation.

 

Article 16 Local vocational colleges and enterprises shall be encouraged to carry out cross-regional school-enterprise cooperation with vocational colleges and enterprises in the northwest, central and western regions of Liaoning Province, so as to promote the development of vocational education in poverty-stricken areas, ethnic minority areas and old revolutionary base areas. Support local vocational colleges, enterprises and domestic high-level vocational colleges and well-known enterprises to carry out cross-regional school-enterprise cooperation, to enhance the level of school-enterprise cooperation.

 

Article 17 The administrative department of education and the social security department of human resources shall, in conjunction with the relevant departments of industry and information technology, establish an information service platform for the integration of industry and education, and guide and assist vocational colleges in establishing cooperative relations with relevant enterprises.

 

Relevant departments, industries and enterprises are encouraged to jointly build an information-based platform for school-enterprise cooperation with connectivity, and various social entities are guided to participate in the development of the platform and share information.

 

Article 18 The administrative department of education shall regard school-enterprise cooperation as the basic index to measure the level of running a vocational college and put forward corresponding requirements in the aspects of school establishment, specialty construction, enrollment plan, teaching evaluation, teacher allocation, project support, school evaluation and personnel assessment, etc. New majors set up by school-enterprise cooperation to meet the needs of the job market should be supported; We will guide and support vocational colleges and enterprises to cooperate with each other in setting up majors, formulating professional teaching standards, curriculum standards and personnel training programs, and developing teaching materials and digital teaching resources.

 

Article 19 Vocational colleges shall admit representatives of enterprises with close and stable cooperative relations to join the working committee for school-enterprise cooperation and participate in the deliberation of major issues of the school. Vocational colleges and universities shall fully listen to the opinions of the cooperative enterprises when setting up majors, formulating training programs and teaching standards.

 

Article 20 Vocational colleges shall be encouraged to cooperate with enterprises to develop apprenticeship training. Schools that carry out apprenticeship training shall listen to the opinions of enterprises in terms of enrollment majors and quotas. Enterprises that have the ability and demand to train technically skilled personnel can cooperate with vocational colleges to establish apprenticeship positions, jointly determine training programs, and carry out training in a work-integrated learning mode.

 

The administrative department of education and the social security department of human resources shall give preferential treatment and support to the enrollment planning and management of students' status.

 

Article 21 Where a vocational college and an enterprise reach a cooperation agreement on the participation of students in post practice, working practice and apprenticeship training, it shall sign a tripartite agreement among the school, the enterprise and the student, and clarify the responsibilities of the school and the enterprise in safeguarding the lawful rights and interests of the students. The enterprise shall protect the basic labor rights and interests of the internship students or apprentices in accordance with the law and regulations, and pay their remuneration in full and on time in accordance with the relevant provisions. No unit or individual may deduct such remuneration. The enterprise accepts the interns to pay for the labor insurance to practise the preferential policy of first surrender and then retreat.

 

Article 22 Vocational colleges and internship units shall insure the internship liability insurance for the internship students, clarify the obligations and responsibilities of the internship liability insurance, and improve the protection of students' rights and interests and the risk-sharing mechanism. Support insurance companies to develop insurance products for modern apprenticeships and new apprenticeships.

 

Article 23 An enterprise shall establish a compensation mechanism for the cost of accepting students for practical training, and encourage enterprises to accept students for practical training directly by exploring ways of purchasing services and implementing tax policies. We will promote the standardization of practical training and ensure that students enjoy legitimate rights and interests such as obtaining reasonable remuneration.

 

Article 24 Actively cultivate enterprises integrating industry with education, and provide convenient support in project examination and approval, purchase of services, financial support and land use policies to the construction and cultivation enterprises incorporated into the construction information bank of enterprises integrating industry with education. For the enterprises that enter the certification catalogue of industry-education integrated enterprises, the combined incentive of 'finance + fiscal + land + credit' shall be given, and relevant tax policies shall be implemented according to regulations. If the investment in establishing vocational education by the pilot enterprise for the construction of integration of industry and education meets the requirements, the enterprise shall be credited with the additional education fees payable by the enterprise in the current year and the additional local education fees in accordance with a certain proportion of the investment amount.

 

Article 25 Support for school-enterprise cooperation shall be encouraged in the form of cooperation between the government and social capital and purchase of services. We will encourage competitive selection of social capital, and support enterprises and schools in building public practice centers, innovation and entrepreneurship bases, research and development of practical courses, teaching resources, and other public service projects. Vocational colleges are encouraged to jointly build production-oriented training bases or teaching factories with enterprises through leasing venues and equipment, and corresponding preferential policies are given according to relevant regulations.

 

Article 26 Business activities or enterprises run by vocational colleges themselves with the main purpose of serving students' practice and training shall enjoy preferential tax treatment in accordance with the relevant provisions of the State.

 

Article 27 Enterprises shall be encouraged to accept students for internships, practical training and apprenticeships. Enterprises shall be deducted, in accordance with law, when calculating the taxable income amount, from reasonable expenditures related to income incurred by the receiving students as well as expenditures incurred in vocational education.

 

Article 28 Encourage enterprises to invest in and donate vocational education, and allow deductions from the amount of taxable income of the enterprise income tax for the portion of the donation expenditure of the enterprise for educational undertakings through public welfare social organizations or governments and their departments at or above the county level that is less than 12% of the total annual profit; Any portion exceeding 12% of the total annual profit shall be allowed to be deducted from the calculation of taxable income within three years after the carry-over.

 

Article 29 Encourage the revitalization of the use of existing construction land to support school-enterprise cooperation of vocational colleges, and give priority support in the land use and supply plan in accordance with the annual construction tasks determined by the school-enterprise cooperation plan.

 

Article 30 Financial institutions shall be encouraged to prudently grant credit according to law and regulations, and provide relevant credit and financing support for school-enterprise cooperation. Actively support qualified enterprises in carrying out equity financing and bond financing in the capital market, and increase investment in school-enterprise cooperation projects such as internships and training bases.

 

Article 31 Relevant government departments shall, in accordance with law, support vocational colleges and universities in changing their business scope for the purpose of carrying out vocational training, technical development, consulting services, continuing education and academic exchange. Allow vocational colleges to provide paid services to the society, carry out paid services and school-enterprise cooperation income, school-run industry annual profits and other income, should be included in the school financial unified accounting and management, can be used as a certain proportion of the total increase in performance wages as a source of performance wages for teaching and administrative staff. A certain proportion of the work-study income obtained by permitting vocational colleges to carry out production service practice training can be drawn to pay students labor remuneration. In the school-enterprise cooperation, the school may obtain the remuneration of intelligence, patent, education, labor and so on, and the specific distribution shall be handled by the school itself according to the regulations.

 

Article 32 Enterprises above the designated size shall be encouraged to rely on the institutions of staff training and continuing education of vocational colleges and universities to carry out staff training and the recognition of learning results of continuing education, and to realize mutual recognition and convergence with the education of vocational colleges and universities in accordance with relevant provisions and methods.

 

Article 33 State-owned enterprises and vocational colleges shall be supported to carry out in-depth cooperation in various forms, such as co-construction of specialties, teacher training, staff training and technical services. Enterprises above the designated size shall arrange internship posts to accept students for practical training.

 

Enterprises that have participated in school-enterprise cooperation in depth, behaved in a standardized manner, achieved remarkable results, and have great influence shall be commended and given corresponding policy support in accordance with the relevant provisions of the State.

 

The competent departments of various industries shall regard the participation of enterprises in school-enterprise cooperation as an important index for the selection of relevant model enterprises.

 

Article 34 The filing system of vocational education groups or school-enterprise cooperation alliances shall be implemented, and the establishment of close-knit vocational education groups linked by capital and supported by specialties shall be supported, and a number of backbone vocational education groups or school-enterprise cooperation alliances with exemplary and leading functions shall be built.

 

Supporting industry-education integration enterprises and education-oriented enterprises to play an important role in vocational education groups, school-enterprise cooperation alliances and industry teaching steering committees; Support enterprises, vocational colleges, scientific research institutions, trade associations or other organizations to form industry-education alliances on a voluntary basis and make them operational on a substantive basis.

 

Article 35 Encourage school-enterprise cooperation to develop apprenticeship training, Schools and enterprises that have been recognized by the administrative department of education or the department of human resources and social security as implementing the apprenticeship system may be subsidized by the relevant government departments according to regulations with financial funds or funds for staff and workers' training, and enterprises shall allocate a certain proportion of funds for staff and workers' education and training for apprenticeship training.

 

Article 36 Social forces shall be encouraged to organize or participate in the organization of vocational education through sole proprietorship, joint venture or cooperation, and secondary colleges of mixed ownership shall be encouraged.

 

Article 37 To promote the rational flow and effective allocation of human resources in vocational colleges and enterprises. Vocational colleges and universities may arrange a certain proportion of the total number of staff and workers, or in the form of mobile posts, etc., to employ management personnel, professional and technical personnel and highly skilled personnel as part-time teachers to the public and enterprises. Professional and technical personnel of vocational colleges shall have the same right to participate in the evaluation of professional titles as those on-the-job personnel of the personnel relations unit during the period when they are on temporary duty in the enterprise or participate in the project cooperation.

 

Article 38 The part-time and part-time salary system for business management personnel, professional and technical personnel, highly skilled personnel, management personnel of vocational colleges and teachers shall be improved. With the consent of the school or the enterprise, the management personnel and teachers of the vocational college and the business management and technical personnel of the enterprise who work part-time in the enterprise or the school according to the cooperation agreement may determine the remuneration in accordance with the relevant provisions and the agreement between the two parties. Vocational colleges and universities, teachers and students who have the achievements of technological development and product design with intellectual property rights may, according to law and regulations, make shares in enterprises at prices; Educational and teaching achievements made by enterprise personnel in school-enterprise cooperation may be regarded as corresponding technological or scientific research achievements and shall be rewarded according to regulations. Vocational colleges and enterprises shall enjoy the autonomy of use, disposal and revenue management of the patented products jointly developed by them in accordance with the agreement between the two parties.

 

Article 39 Vocational colleges and universities shall regard the practical experience of industrial enterprises as a necessary condition for recognizing the educational and teaching abilities and obtaining the qualifications of professional course teachers. Professional teachers in vocational colleges shall be trained in enterprises or training bases for at least one month every year, and implement the whole staff rotation training system for teachers in a five-year cycle. New teachers who have no working experience in an enterprise should practise before taking up their posts. Teachers and administrators of public basic courses shall also visit enterprises regularly for investigation, research and study.

 

Article 40 Vocational colleges and enterprises shall regard participation in school-enterprise cooperation as an important part of the performance appraisal of teachers and employees, and give priority to it under the same conditions in terms of evaluation of professional titles, employment of posts, evaluation and commendation of excellence, etc.

 

Article 41 We will support the 'going out' of vocational college conglomerates and establish school-running institutions and research and development institutions in countries along the Belt and Road. We will support enterprises undertaking large-scale overseas projects and vocational colleges to jointly establish international personnel training bases, and speed up the training of technical and skilled personnel to meet the requirements of 'going out' of enterprises.

 

Article 42 Relevant departments of the municipal, county (city, district) government shall commend and reward the personnel who have made outstanding contributions to the school-enterprise cooperation, and actively create a good atmosphere in which the whole society fully understands, strongly supports and deeply participates in the school-enterprise cooperation.

 

Chapter IV Supervision and Inspection

 

Article 43 The educational supervision department of the municipal or county (city or district) government shall be responsible for carrying out special supervision over the implementation of the duty of school-enterprise cooperation by various departments and vocational colleges, and shall issue supervision reports on a regular basis.

 

Article 44 The administrative department of education and the social security department of human resources shall regard the cooperation between schools and enterprises as an important part of the evaluation of school-running performance and level and the evaluation of work objectives of vocational colleges, and strengthen supervision, guidance, inspection and service of school-enterprise cooperation with relevant departments and trade organizations such as industry, information technology and state-owned assets management.

 

Article 45 Vocational colleges and enterprises shall protect the lawful rights and interests of students, teachers and employees of enterprises in the process of cooperation; Those who violate the provisions of relevant laws and regulations shall be ordered to rectify by the relevant competent departments, and the relevant units and personnel shall be investigated for responsibility in accordance with the relevant regulations.

 

Article 46 An enterprise shall draw and use the funds for education and training of staff and workers in accordance with the provisions, and if it fails to use the funds in accordance with the provisions, it shall be ordered to make corrections and shall be recorded in the credit records of the enterprise; If the enterprise refuses to make corrections, the government at or above the county level shall, in accordance with law, collect funds for the education and training of workers and staff members to be borne by the enterprise and use them as a whole for local.

 

Article 47 If a vocational college or enterprise defrauds or obtains government funds, the competent department concerned shall order it to return the funds within a time limit, and shall investigate the responsibility of the unit, its principal responsible person and the person directly responsible in accordance with the law and regulations. If the case constitutes a crime, criminal responsibility shall be investigated according to law.

 

Article 48 Where the relevant administrative departments and their staff members violate these Measures by neglecting their duties, abusing their power or engaging in malpractices for personal gain in school-enterprise cooperation, they shall, in accordance with the law and discipline, impose administrative and disciplinary sanctions on the persons in charge and the persons directly responsible; If the case constitutes a crime, criminal responsibility shall be investigated according to law.

 

Chapter V Supplementary Provisions

 

Article 49 The term 'vocational colleges' as mentioned in these Measures refers to secondary vocational schools (including general secondary specialized schools, adult secondary specialized schools, vocational high schools and technical schools), higher vocational colleges and higher vocational and technical colleges established independently according to law.

 

The term 'enterprises' as mentioned in these Measures refers to all kinds of enterprises registered with the market supervision and administration departments at all levels.

 

Article 50 These Measures are applicable to the school-enterprise cooperation between vocational colleges within the administrative area of Dalian Municipality and enterprises within or outside the State (territory).

 

In addition to the implementation of these Measures, other relevant laws and regulations shall also be implemented in the school-enterprise cooperation between vocational colleges and domestic (foreign) enterprises.

 

Article 51 The present Measures may be referred to by colleges and universities at other levels and types for carrying out school-enterprise cooperation, and by vocational colleges and universities for carrying out cooperation with organs, institutions, social organizations and other institutions.

 

Article 52 These Measures shall come into force as of January 1, 2020.
