Dalian Business Environment Construction Interview System

Article 1 In order to further promote the implementation of the important work of business environment construction, timely correct and effectively solve the cases of work deviation and key problems in the construction of the business environment, further improve the business environment construction system and promote the implementation of the responsibility for the construction of the business environment. This system has been formulated in accordance with the Liaoning Optimizing the Business Environment Regulations, the Liaoning Business Environment Construction Interview System and other regulations, and in combination with the actual construction of the business environment in our city. 

Article 2 This interview system can be applicable to all member units of the municipal business environment construction leading group, the main leaders and leaders with specific duties of the people's governments of the districts, cities and counties, the administrative committees of the pilot zones, the main leaders and leaders with specific duties of the municipal direct department of business environment construction, and the main leaders of relevant enterprises and institutions, etc. 

Article 3 The interviews should adhere to the principle of "Based on facts, being serious, prevention first, asking one thing at a time, and implementation at different levels".

Article 4 The ways of interview. 

(1)    Interviews are organized and implemented specifically by the municipal business environment construction supervision office (hereinafter referred to as the municipal business environment office), mainly through individual interviews and collective interviews. 

(2)    Establish the two-level interview system of "Interviewed by the municipal business environment office, and interviewed by the city leaders", depending on the specific circumstances. 

(3)    For general work and problems, the municipal business environment office conducts interviews with leaders with specific duties of the governments of districts, cities, and counties, the leaders with specific duties of administrative committees of the pilot zones, and leaders with specific duties of the institutions directly under the municipal government. 

(4)    For cases of important work and major issues, the leaders of the municipal government conduct interviews with the main leaders of the governments of districts, cities and counties, the main leaders of the administrative committees of the pilot zones, and the main leaders of the institutions directly under the municipal government. 

Article 5 The circumstances of the interviews. Under any of the following circumstances, interviews shall be conducted in a timely manner. 

(1)    The leaders, departments, other relevant offices and others, who are not effective in the implementation of the work deployments of the central government and country on deepening the reform of "Decentralization, Management and Service" and optimizing the business environment, the Liaoning Optimizing the Business Environment Regulations and work deployment of the municipal party committee and the municipal government on the construction of the business environment. 

(2)    Institutions and individuals criticized by the State Council, the provincial party committee and the provincial government and institutions, individuals directly mentioned, and clearly instructed by the municipal leaders. 

(3)    There are problems of poor leadership, dereliction of duty, without responsibilities, negative act and other acts with the leading cadres of the region, the institutions in the business environment construction work.

(4)    The serious awful cases occurred in the institutions and the regions have a bad impact, seriously damaging the image of regional business in the regions, the whole city, the whole province and even the whole country. 

(5)    The municipal business environment office finds outstanding problems and signs of major hidden dangers in the business environment supervision work, which the municipal business environment office needs to correct and solve immediately. 

(6)    The relevant departments, offices and others, whose completion rate of business environment cases is low, which does not meet the requirements of the provincial business environment construction bureau, the municipal party committee and the municipal government, and have not effectively improved it for a long time will be interviewed; and there are relevant departments, offices and others, who have the problems of having "false satisfaction" and "false completion" in the process of handling the complaints of the business environmental, will be interviewed, too. 

(7)    The relevant departments, offices and others, who fail to seriously accept and solve, not appropriately handle cases of business environment problems complained, reflected and reported by the masses of enterprises, or deceive the masses of enterprises and not take their responsibilities for various reasons, will be interviewed. 

(8)    The relevant departments, offices and others, who promote the construction of the "Five Ones" project for the business environment ineffectively, will be interviewed. The relevant departments, offices and others, whose progress is slow, who can’t cooperate well with the business environment office, will be interviewed. And the relevant departments, offices and others, whose tasks of implementing the municipal business environment construction targets are not up to standard, will be interviewed. 

(9)    Other circumstances that need to be interviewed.

Article 6 Procedures for interviews. 

(1)    Determine the interview objects. The municipal business environment office regularly sorts out and summarizes the work according to the work deployment of the municipal party committee and the municipal government and the stage tasks of the provincial business environment construction, formulates an interview plan, and determines the interview objects and interview ways. 

(2)    Issue an interview notice. The municipal business environment office issues an interview notice to the interviewee, clearly informing the interviewee of the time, place, content and ways of the interview, and the interview conducted by the municipal business environment office can be organized and implemented after the approval of the municipal leaders. When it comes to interviews with municipal leaders, the municipal business environment office needs to propose instructions to the relevant municipal leaders in advance and organizes and implements with the consent of the municipal leaders. The time and place of the interviews will be designated by the municipal leaders. 

(3)    Make records of interviews. Interviews should be recorded. It should be explained to the interviewees the reasons and matters, put forward clear rectification measures and time limits, and put forward rectification requirements. The interviewees should make a statement on the contents of the interview and the rectification opinions. After the interview, both parties to the interview should sign the Interview Record Form for confirmation.  It’s necessary to establish records for all interview records and they should be kept by the municipal business environment office. 

(4)    Pay attention to interview effects. The municipal business environment office is responsible for the feedback and rectification work after the interview to ensure the interview effects. Within 7 working days after the interview, the interviewee should write a special rectification report to the municipal business environment office in written form, if it involves the implementation of long-term rectification, and the interviewee should adhere to the regular reports. The municipal business environment office is responsible for following up and supervising the implementation until the problem is completely solved. 

Article 7 Interviews must be based on facts, adhere to timely and moderately strict control, not random interviews, not non-principled interviews, and ensure the seriousness of interviews. 

Article 8 This interview system shall be interpreted by the municipal business environment construction supervision office and shall come into force as of the date of promulgation.
