Please earnestly implement it.

Guidelines (Trial Implementation) for the Classification of Project Approval of Dalian Engineering Construction Project Approval System Reform

Article 1 These Guidelines are formulated to refine the classification of Engineering Construction Project Approval in our city, correspond to the refinement of the approval process, and make a decision of the approval stages and the approval items. 

Article 2 These classification guidelines are applicable to the planning, consultation, approval, design, etc. in the early stage of engineer construction projects, with the exception of special projects. 

Article 3 The classification of engineer construction shall not only conform to the guidelines of this classification, but also conform to the provisions of the current relevant national standards. 

The social investment is in the general industries and warehousing projects.

Article 4 The social investment in the general industrial and warehousing projects can be divided into industrial projects in industrial parks, warehousing projects in logistics parks and new construction, rebuilding, expansion, rehabilitation and decoration and renovation projects of enterprise technological transformation projects according to the nature of use.

Article 5 The social investment in the general industrial and warehousing projects shall have thorough and full construction conditions through the pre-planning generation mechanism, and the generation results shall be sent to the approval stage. The approval stage includes:

1. The approval stage of land use planning with the project approval(Approval time: the projects, which have been carried out the record management, will be completed immediately; For projects have been carried out the approval management, the approval time referring to the financial investment and financing projects is 15 working days.) 

2. Construction Permit Phase (Approval time: 15 working days). 

If the social investment with the transfer plan is in the general industrial and warehousing projects and the construction unit promises to organize and implement strictly in accordance with the design plan agreed upon at the time of transfer, the design plan will be exempted from examination and the planning permit of engineer construction project and the construction permit will be jointly issued. If the social investment is in general industrial and warehousing projects without the transfer of the plan, or the construction unit makes major changes to the design plan agreed upon at the time of transfer, after the planning competent department determines that if it has to be added the joint review of the design plan (Approval time: 12 working days), and the construction permit stage can only be entered after the review is passed. 

3. Completion Acceptance Phase (Approval time: 20 working days). 

Article 6 The use of stock land and social investment in general industrial and warehousing newly construction, rebuilding and expansion projects that do not change the nature of land use can simplify the handling of engineer construction project planning permits after being filed by the competent departments of land and resources. 

Article 7 For the following construction projects, the construction units or individuals shall apply for a joint review of the design scheme and an engineer construction project planning permit in accordance with the regulations:

1. Overhaul works of buildings or structures that need to change the main load-bearing structure. 

2. Building facade reconstruction projects within the area determined by Dalian Municipal People's Government. 

The social investment is in the small and medium-sized civil projects.

Article 8 Small and medium-sized civil projects with social investment are suitable for projects with a construction area of not more than 5000 square meters, a height of not more than 24 meters, a single function and relatively simple technology. Civil construction projects can be divided into residential buildings, office buildings, hotel buildings, commercial buildings, residential service buildings, cultural buildings, educational buildings, sports buildings, health buildings, scientific research buildings, traffic buildings, civil air defense buildings, radio, film and television buildings, etc.

Article 9 Small and medium-sized civil projects with social investment shall fully prepare conditions for construction through the pre-planning generation mechanism, and the generation results shall be sent to the approval stage. 

The approval stage includes:

1. The approval stage of approval land use planning (Approval time: the projects, which have been carried out the record management, will be completed immediately; For projects have been carried out the approval management, the approval time referring to the financial investment and financing projects is 15 working days.) 

2. Engineer Construction Permit Phase (Approval time: 20 working days).

3. Construction Permit Phase (Approval time: 20 working days). 

4. Completion Acceptance Phase (Approval time: 20 working days). 

Article 10 The use of stock land and the social investment in the small and medium-sized civil newly construction, rebuilding and expansion projects, that do not change the nature of land use can simplify the handling of engineer construction project planning permits after being filed by the competent departments of land and resources.    

Article 11 For the following construction projects, the construction units or individuals shall apply for a joint review of the design scheme and a engineer construction project planning permit in accordance with the regulations:

1. Overhaul works of buildings or structures that need to change the main load-bearing structure. 

2. Building facade reconstruction projects within the area determined by Dalian Municipal People's Government. 

Other Social Investment Projects

Article 12 Social investment projects other than the above-mentioned land use classification. 

Article 13 Other types of social investment projects should prepare thorough and full conditions for construction through the pre-planning generation mechanism, and the generation results are sent to the approval stage. 

The approval stage includes:

1. The approval stage of approval land use planning (Approval time: the projects, which have been carried out the record management, will be completed immediately; For projects have been carried out the approval management, the approval time referring to the financial investment and financing projects is 15 working days.) 

2. Engineer Construction Permit Phase (Approval time: 20 working days). 

3. Construction Permit phase (Approval time: 35 working days). 

4. Completion Acceptance Phase (Approval time: 20 working days). 

For other social investment projects with transfer plans, if the construction unit promises to organize and implement strictly in accordance with the design plan agreed upon at the time of transfer, the design plan will be exempted from review, and the competent planning department can directly handle the engineer construction project planning permission (Approval time: 8 working days) according to the relevant commitment of the construction unit, and the construction units can enter the construction permission stage. 

Article 14 The use of stock land and social investment projects of other types that do not change the nature of land use may simplify the handling of engineer construction project planning permits after being filed by the competent departments of land and resources.

Article 15 For the following construction projects, the construction units or individuals shall apply for a joint review of the design scheme and an engineer construction project planning permit in accordance with the regulations:

1. Overhaul works of buildings or structures that need to change the main load-bearing structure. 

2. Building facade reconstruction project within the area determined by Dalian Municipal People's Government.

Financial investment and financing housing construction projects (Including municipal station facilities and comprehensive pipe galleries)

Article 16 Financial investment and financing housing construction projects (Including municipal station facilities and comprehensive pipe galleries) shall prepare thorough and full conditions for construction through the pre-planning generation mechanism, and the generation results are sent to the approval stage.  The approval phase includes:

1. Approval phase of approval land use planning (Approval time: 15 working days). 

2. Engineer Construction Permit Phase (Approval time: 20 working days). 

3. Construction Permit Phase (Approval time: 35 working days). 

4. Completion Acceptance Phase (Approval time: 20 working days). 

Article 17 For the following construction projects, the construction units or individuals shall apply for a joint review of the design scheme and an engineer construction project planning permit in accordance with the regulations:

1. Overhaul works of buildings or structures that need to change the main load-bearing structure. 

2. Building facade reconstruction project within the area determined by Dalian Municipal People's Government.

The municipal financial investment and financing linear engineer projects for the government.

Article 18 Linear Professional Pipelines: Including underground pipelines , comprehensive pipes and ditches, and subsidiary facilities with different uses, of the urban roads, bridges, tunnels, subways, parks, squares, etc. with new construction, renovation and expansion, such as water supply, drainage, gas, heat, electricity, lighting, communications (Including communications, radio and television, traffic signals, urban monitoring, national defense communications, etc.) within the red line of municipal public works planning. 

Article 19 Industrial Pipelines: Including oil pipelines, natural gas pipelines (Including natural gas pipes of natural gas delivery pipeline distribution stations or the terminal stations) and various medium delivery pipelines passing through public areas outside the enterprises. 

Article 20 Urban Roads: Refers to roads, tunnels, culverts, bridges and their ancillary facilities in cities for vehicles and pedestrians to pass through and with certain technical conditions.

Article 21 The municipal financial investment and financing linear engineering projects shall prepare full and thorough conditions for construction through the early planning generation mechanism, and the generation results are sent to the approval stage. 

The approval phase includes:

1. Approval phase of approval land use planning (Approval time: 15 working days). 

2. Engineer Construction Permit Phase (Approval time: 20 working days). 

3. Construction Permit Phase (Approval time: 35 working days). 

4. Completion Acceptance Phase (Approval time: 20 working days ). 

Article 22 New Projects: Refers to projects that start from zero, and newly build.  If the original foundation of a construction project is very small and the value of its newly increased fixed assets exceeds the value of its original fixed assets by more than three times after the expansion of the construction scale, it is also a new project. 

Article 23 Reconstruction Projects: Refers to a project in which the original enterprise uses new technology to improve product quality or change the direction of new products in order to improve production efficiency and increase scientific and technological content without changing the nature of land use. In order to balance production capacity, some enterprises have added some ancillary, auxiliary workshops or non-productive projects, which are also reconstruction projects. 

Article 24 Expansion Projects; Refers to the construction of major workshops or projects by the original enterprises and institutions in order to expand the production capacity of the original products (Or improve the efficiency) or increase the production capacity of the new products. 

Article 25 Rehabilitation Projects: Rehabilitation should be carried out in strict accordance with the principle of "Original site, original area, original height and original nature of use". Among them, the "Original site" refers to the location where the external walls of the existing building are located; The "Original area" refers to the area contained in the current housing use warrants; The "Original height" refers to the measured height and shape of the roof surface of the existing house; The "Original nature of use" refers to the nature of use of the house on the property right certificate.

If the buildings approved for renovation are located in special areas such as historic areas, historic and cultural blocks, historic areas, etc., in principle, they shall not change the form, style and appearances of the original building structure except in accordance with the principles mentioned in the preceding paragraph.  The reconstruction of historical buildings and immovable cultural relics must comply with relevant laws and regulations. 

Supplementary Provisions

Article 26 These Guidelines shall be interpreted by the office of the leading group for the pilot reform of the approval system for municipal engineering construction. 

Article 27 These Guidelines shall be implemented from the date of promulgation
