Rules for Management of Construction Project Generation in Dalian (for trial implementation)

 

CHAPTER Ⅰ General rules

 

Article 1 In order to strengthen the planning and generation of construction projects, and to promote the construction of projects scientifically, According to the Circular of the General Office of the State Council on the Pilot Reform of the examination and Approval System for Engineering Construction Projects (No. 33) issued by the State Office (2018) and the "Implementation Plan for the Pilot Reform of the Examination and Approval System of Engineering Construction Projects in Dalian" (No. 118), This procedure is formulated.

 

Article 2 This regulation is applicable to the management of new construction, reconstruction and extension projects in our city. If the project land is non-state-owned construction land, it shall go through the formalities of land collection to transfer in accordance with relevant provisions first.

 

According to the different ways of investment, the projects are divided into social investment projects and financial investment and financing projects. Social investment projects refer to social invest in general industrial, warehousing projects, small-and medium-sized civilian projects and other types of projects. Financial investment and financing projects refer to housing and construction projects (including municipal station facilities, integrated pipe corridors) and municipal linear engineering projects.

 

The construction projects to be submitted to the State and the provinces for approval shall be executed in accordance with the relevant regulations at the higher level.

 

Article 3 The Office of Dalian Construction Land Collection and Storage Planning and Trading Committee (hereinafter referred to as "the three Committees") is responsible for the overall coordination and supervision of the construction project generation and management. All relevant departments shall be responsible for the specific work of construction project generation management in accordance with these regulations.

 

Article 4 Establish the project planning and generation mechanism supported by "one blueprint" and “multi-planning in one”, and the construction project generation management relies on the concrete implementation of "multi-planning in one" service construction platform.

CHAPTER Ⅱ Social Investment Project Generation Management

 

Article 5 The generation of social investment projects is managed according to the annual land collection, storage and transfer plan formulated by the government, carry out the Land belt scheme transfer system on general industrial land project.

 

Article 6 The land and housing administration department takes the lead in formulating the annual land collection, storage and transfer plan. Use "one Blueprint" to query natural resources information, research on the conformity of Project Planning based on the Natural Resources Information Inquiry report and formulate the annual land storage and transfer plan.

 

The annual land collection, storage and transfer plan for social investment projects shall be formulated and implemented in accordance with the following procedures.

 

1)     The draft plan proposes that the land and housing administration departments take the lead, together with the municipal and county governments of all districts, the leading district management committees, and so on, according to the needs of the national economy and social development and the land market situation, before the end of November of each year. Organize and put forward the land collection and reserve transfer plan for the next year (draft) and submit it to the planning management department.

 

2) Space implementation planning: according to the annual land collection, storage and transfer plan (draft), the planning and management department shall carry out land capacity research, analysis of the carrying capacity of facilities, and micro urban design within 30 working days. Form an annual space implementation plan for social investment projects (proposal draft) . Through the "multi-planning in one" service construction platform sent to the land housing, ocean, forestry, environmental protection, urban construction, commerce, heritage protection, national security, meteorology and other administrative departments for advice and all departments shall feedback their opinions within 10 working days. Those who fail to do so shall be deemed to have no objection.

 

3)Solicitation of opinions: land and housing management departments to verify whether the project conforms to land supply policy and put forward opinions, put forward the requirement of Rental Housing for the Housing (apartment) Development Project.

 

The marine administrative department verifies the approval level of the sea and the progress of the approval of the project at the sea level for projects that require reclamation.

 

The forestry administrative department verifies whether conforms to the forest land utilization plan, puts forward the project uses the forest opinion.

 

Environmental management department verifies whether conforms to the compliance with environmental protection planning and put forward environmental advice.

 

The urban construction management department shall verify whether it complies with the special planning regulations and requirements for urban construction (roads, flood control and drainage, greening and sanitation), and put forward opinions.

 

The department of cultural relics protection shall verify whether it complies with the regulations for the protection of cultural relics and make comments.

 

The State Security Administration shall verify compliance with national security matters and make comments.

 

Business management verifies compliance with oil products distribution system planning and put forward views on the development of the industry.

 

The meteorological administration department shall verify compliance with the meteorological facilities and environmental protection regulations for meteorological observation and make comments.

 

The planning and management departments collected and sorted out the opinions of various departments, form the annual land use space implementation plan for social investment projects, enriched and improved the annual land collection, storage and transfer plan (draft), and submitted it to the land and housing management department in early January of the following year.

 

 

4) Plan for approval: the land and housing administration departments shall, in conjunction with the annual space implementation plan for social investment projects and the annual plot control plan, supplement and perfect the annual land collection, storage and transfer plan (draft) for social investment projects. Submit the procedure to the municipal government for approval before the end of January of the following year.

 

5) Plan: land and housing management department officially issued the social investment project annual land reserve transfer plan within 5 working days after the approval of the municipal government.

 

The annual land collection, storage and transfer plan should define the name of the land block, plan the conditions, simulated transfer time, implement the division of work, complete the time limit, and the unit of responsibility, and so on.

 

6)  Plan implementation: each Prophase work responsibility unit shall, according to the plan, make the completion of transferring programme development within the specified time frame, net provision and other preliminary work. The land and housing management department will lead the organization to report the transfer plan to the "three committees" joint meeting for examination in accordance with the procedures and will be approved by “three committees”.

 

7) Plan additions: projects that are not included in the annual land collection, storage and transfer plan shall, after study by the district, city, county and county governments and the leading district administration committee, be organized and transferred as unplanned new projects, The project responsibility department and commercial land housing administration launch the supplement plan.

 

Article 7 General industrial land project transfer scheme is formulated and implemented according to the following process.

 

1) Project Start-up: the city and county governments of all districts, the leading district management committee combined with the demand for investment, scroll to start the project, put forward the location intention, industry positioning, construction content and scale and other related pre-materials, Through the "multi-rules in one" service construction platform sent letter to trusting, planning, environmental protection and other management departments for advice.

 

2) Solicitation of opinions: after the trusting, planning, environmental protection and other management departments to verify the project, each department should feedback within 5 days after receiving relevant prior information, overdue feedback is deemed to be no objection.

 

Whether trusted management department promotes conforms to the industrial positioning review opinion.

 

Planning management put forward preliminary views on planning.

 

Environmental management department verifies compliance with environmental planning and puts forward environmental advice.

 

District and county governments, leading district management committees collect the audit opinions of various departments, and the approved projects shall be submitted to the land and housing management department.

 

3) Preparation of planning conditions: land and housing management department shall submit the pre-project materials and audit opinions to the planning management department. The planning management department shall complete the preparation of the planning conditions within 10 working days and submit them to the land and housing administration department, the municipal and county governments of each district and the leading district management committee after the approval according to the procedure.

 

 

4) Transfer program formulation and approval: land and housing management departments lead together with the city and county governments, leading district management committee, according to the planning conditions formulate the transfer program in 15 working days.

 

5) Program implementation: land and housing management departments lead, organize and carry out the work of public transfer of project land according to procedures timely.

 

Article 8 The administrative department of land and housing shall take the lead in establishing a reserve bank for social investment projects. The district and county governments and the leading district management committee shall enter their intention in time into the project reserve bank.

 

CHAPTER Ⅲ Financial Investment and financing Project Generation Management

 

Article 9 The project management departments which manage the Development and Reform of Financial Investment and financing projects together with the planning management department, land and housing management department, construction management department and various industry departments in charge shall set up the whole city construction project reserve bank according to the plan and put forward the short-term construction protect plan.

 

Article 10 The planning management department shall carry out the compilation of the financial investment and financing project implementation plan in combination with the planning results of "multi-planning in one". Financial investment and financing projects shall be generated in clear pre-selected sites, land use indicators, relevant departmental opinions and other matters. Approved project proposals (or implementation schemes) are the basis for entry into the approval process.

 

Article 11 Financial investment and financing projects according to the following processes to carry out generation management.

 

1) Project initiation: according to the recent construction project plan, the planning management department shall carry on the natural resources information inquiry using "one blueprint", and according to "the natural resources information inquiry report", carry on the research and the judgment to the project plan conformity, in conjunction with the development reform, The departments in charge of land, housing, construction and other related industries, project units, in combination with the financial investment and financing projects, implement the plan, put forward the project location intention, preliminary construction content and scale, etc. Through the "multi-regulation in one" service construction platform sent them to the relevant management departments for advice.

 

2) Comment solicitation: land and housing management departments shall verify whether it conforms to the overall land use plan, whether it conforms to the land allocation catalogue, whether it conforms to the requirements of intensive land conservation, and whether it has the annual planning targets for new construction land.

 

The marine administrative department verifies the approval level of the sea and the progress of the approval of the project at the sea level for projects that require reclamation.

 

The forestry administrative department shall verify whether to occupy the forest land, put forward the opinion on forest use.

Environmental management department shall verify compliance with environmental planning and put forward environmental advice.

 

The urban construction management department shall verify whether it complies with the special planning regulations and requirements for urban construction (roads, flood control and drainage, greening and sanitation), and put forward opinions.

 

The department of cultural relics protection shall verify whether it complies with the regulations for the protection of cultural relics and make comments.

 

The State Security Administration shall verify compliance with national security matters and make comments.

 

The meteorological administration department shall verify compliance with the meteorological facilities and environmental protection regulations for meteorological observation and make comments.

 

Projects involving key urban areas and ecologically sensitive areas should be studied and demonstrated in advance. The time limit for planning prelocation and verification of construction conditions can be extended appropriately, but in principle the maximum is not more than 20 working days.

 

3) Project proposal approval: upon verification of a project with construction conditions, the project unit shall organize the preparation of the Project proposal and submit it to the Development Reform Department. Development and reform departments in accordance with economic and social development needs to screen, within 5 working days of approval.

 

Project proposal should define project name, construction content and scale, project responsibility department, owner unit, etc.

 

Article 12 After the approval of the project proposal, the planning management department shall consult the public through the government website or other forms according to the need. Land and housing administration departments shall carry out land prequalification and overburden mineral resources report review and other work.

 

Article 13 The approved financial investment and financing projects shall be transferred from the development and reform departments to the project implementation bank and the formal examination and approval procedures shall be initiated.

 

CHAPTER Ⅳ Supplementary Provisions

 

Article 14 According to the principle of "first question responsibility system", the new projects or other special emergency projects specified by the municipal party committee and the municipal government shall be implemented by whoever takes the lead.

 

Article 15 This regulation shall be explained by the Office of Dalian Construction Land Collection and Storage Planning and Trading Committee.

 

Article 16 These regulations shall come into effect as of the date of promulgation.
