Implementation Measures of Remote Different-place Evaluation of Bid of Dalian Public Resources Trading Platform

Chapter 1 General Provisions

Article 1 In order to further standardize the work of remote different-place evaluation of bid in our city and improve the quality of the work of remote different-place evaluation of bid, these measures are formulated in accordance with actual situation and relevant laws and regulations such as the Tendering and Bidding Law of the People's Republic of China, the Government Procurement Law of the People's Republic of China, the Electronic Signature Law of the People's Republic of China, and the Electronic Tendering and Bidding Methods.  Article 2 The term "remote different-place evaluation of bid" as mentioned in these measures refers to the completion of evaluation of bid of projects in Dalian or other provinces and cities by relying on Internet technology, using remote different-place evaluation of bid system, sharing expert resources, using audio and video real-time interactive technology, and online supervision by administrative supervision and management departments.

Article 3 The remote different-place evaluation of bid fields are divided into main fields and auxiliary fields. The evaluation of bid fields, where the projects are, are the main fields and the evaluation of bid fields, where the projects aren’t, are the auxiliary fields. The bidding evaluation experts of auxiliary-field evaluation of bid log in to the main-field evaluation system remotely and conduct evaluation together with the bidding evaluation experts of main-field evaluation of bid. They have the same rights and obligations in the evaluation process. 

Article 4 Both the main fields and the auxiliary fields shall meet the hardware and software and other requirements for remote different-place evaluation of bid.  Chapter II Scope of Application

Article 5 These Measures shall be applicable to remote different-place evaluation of bid on public resources trading platforms. 

Article 6 The bidding evaluation experts shall be composed of bidding evaluation experts from the fields where the projects are and other places where projects aren’t. The bidding evaluation experts who are from the places, where the projects aren’t, shall be randomly selected from the provincial and municipal expert databases outside the place, where the projects are and the specific number shall be determined by the tenderers according to law. 

Article 7 The public resources transaction supervision and administration department may conduct remote different-place evaluation of bids for projects that it deems necessary or that the tender purchasers require remote different-place evaluation of bids. For projects that invite tenders, the remote different-place evaluation of bid may also be conducted upon the application of the tenderer and with the consent of the administrative supervision and administration department. 

Article 8 If the specialty is special, the technology is complex, the requirements are special, or the evaluation time may exceed 8 hours, it is not appropriate to adopt the measure of the remote different-place evaluation of bid.

Chapter III Division of Responsibilities

Article 9 The remote different-place evaluation of bid activities shall be organized and implemented by the tenderers and shall be supervised by the public resources transaction supervision and administration department. 

Article 10 The tender purchasers of projects choosing to carry out the remote different-place evaluation of bid shall make an appointment for the remote different-place evaluation of bid seats at least one working day before the evaluation of bid and register the required expert category, number, time of evaluation of bid at the main fields. Before the evaluation of bid, the experts in the main and auxiliary fields will be randomly selected and the list of experts will be determined. Meanwhile, the list should be kept confidential. Auxiliary-field bidding evaluation experts, who are unable to participate in the evaluation of bid due to avoidance or other reasons shall be fed back to the remote different-place evaluation of bid system in a timely manner. 

Article 11 The operation service organization of the main-field public resources platform is responsible for providing the platform and technical support for remote different-place evaluation of bid activities, and ensuring the operation, safety and stability of the platform. Publish remote different-place evaluation of bid appointments, bid opening, expert identities, expert extractions, evaluation of bid, supervision videos and other information. 

Article 12 The main and auxiliary fields shall set up remote different-place evaluation of bid seats, and designate special personnel to be responsible for the management, order maintenance on the spot and data entry, operation and maintenance of the remote different-place evaluation of bid systems at the main and auxiliary fields.

Article 13 The full-time management personnel of the auxiliary fields shall check and maintain the local evaluation of bid seats before the evaluation of bid, and in case the reserved seats cannot be guaranteed under special circumstances, they shall notify the main fields in time. 

Article 14 In addition to using the remote different-place evaluation of bid system together, the main and auxiliary fields shall also set up special remote different-place seats for evaluation of bid, equipped with computers for evaluation of bid, audio calls, video monitoring, video conferences, desktop monitoring and identification, authentication and other equipment according to standards to ensure the smooth progress of remote different-place evaluation of bid. At the same time, the main and auxiliary fields should organize the testing of local network conditions to ensure the stability of system operation and data transmission during the peak period of evaluation of bid. 

Article 15 The main and auxiliary trading service agencies shall be responsible for the verification and check-in of the member identification of the remote different-place evaluation of bid evaluation committee, keep their communication tools in a unified way, and assist them to log in to the remote different-place evaluation of bid system for evaluation of bid using CA digital certificates (hereinafter referred to as CA). If CA is not enabled, log in to the remote different-place evaluation of bid system according to the evaluation of bid system account number assigned by the main fields for evaluation of bid. 

Article 16 The administrative supervision and management departments and trading service agencies of the main and auxiliary fields shall strengthen the evaluation of the work quality of bidding evaluation experts in remote different-place evaluation of bid. 

Article 17 The main and auxiliary fields should improve the internal management and confidentiality of remote different-place evaluation of bid, pay attention to the supervision and management of the links and process marks of remote different-place evaluation of bid links and process marks, and strengthen the management of key posts and key personnel.

Chapter IV Management of Evaluation of Bid

Article 18 The number of bidding evaluation experts to be drawn for the main fields of remote different-place evaluation of bid should not exceed one-third of the total number of bidding evaluation experts to be drawn for the evaluation of bid. 

Article 19 Members of the Evaluation of Bid Committee shall independently and impartially use the evaluation of bid system in accordance with the requirements of the bidding documents and relevant laws and regulations to grade in a unified manner. In case of any doubt among experts about the bidding documents, the leaders of the evaluation of bid committee shall organize the tenderers and other experts to discuss the matter. 

Article 20 When the evaluation of bid committee needs to discuss and decide in the process of remote different-place evaluation of bid, it shall use the evaluation of bid system or video conference system to vote. When initiating clarification, query, inquiry, etc., the bidders shall complete the clarification online at the main fields by means of video or text communication through the system. If it is necessary to check the originals, the experts at the main fields will check and confirm them. After using the video conference system to communicate, the evaluation of bid committee will confirm it. 

Article 21 Bidding evaluation experts sign personal evaluation forms, summary tables of evaluation of bid, reports of evaluation of bid and other documents with electronic signatures, and leave the fields only after receiving an instruction from the management personnel of the main fields to finish the evaluation. Relevant data of evaluation of bid will be transmitted to the remote different-place evaluation of bid system in real time and used as the evaluation basis for bidding evaluation experts. The main and auxiliary fields shall strengthen the evaluation of bidding evaluation experts' work of evaluation of bid. 

Article 22 If the experts’ electronic signatures of the evaluation of bid in the main and auxiliary fields have not yet been fully issued, the bidding evaluation experts of the main fields shall sign the printed repots of evaluation of bid first, then fax or scan it to the auxiliary fields by the staff of the main fields, and the staff of the auxiliary fields shall hand it over to the bidding evaluation experts for signature before returning them back to the main fields. The signing process shall be carried out under the condition of audio and video monitoring.

Article 23 If the projects of remote different-place evaluation of bid require reconsideration of the results of evaluation of bid, the tenderers shall, in accordance with the relevant regulations, report to the administrative supervision and administration departments for approval, and organize the members of the evaluation of bid committee to conduct centralized review or the remote different-place evaluation of bid. 

Article 24 The whole process of remote different-place evaluation of bid at the main and auxiliary fields shall be subject to the audio and video online supervision of the administrative supervision and administration departments.  The main and auxiliary fields shall make records of evaluation of bid and properly preserve the text and audio-visual materials in the process of evaluation of bid activities for a period of not less than 15 years. 

Article 25 The remote different-place evaluation of bid system shall have the function of automatically recording the data of the remote different-place evaluation of bid around for verification and invocation. 

Chapter V Costs of Evaluation of bid

Article 26 The labor costs of experts in remote different-place evaluation of bid shall be borne by the tenderers. At the end of the evaluation of bid, the system automatically calculates the time of expert evaluation, settles accounts according to the standards specified by the locations, where they are, and pays online.   Article 27 If bidding evaluation experts want more labor costs exceeding the regulations and other conditions, all the behavior will be recorded on the expert behavior evaluation. 

Chapter VI Emergency Safeguard

Article 28 Before the evaluation of bid begins, if the evaluation of bid cannot be carried out due to power failure, network failure, malfunction of electronic equipment, seats of evaluation of bid existing mistakes, or malfunction of  the system of electronic evaluation of bid at the main or auxiliary fields, the bidding can be cancelled within a short period of time (no more than one hour), and the tenderers can delay the time of evaluation of bid and start the evaluation of bid after the failure is cancelled. If the failure cannot be resolved within a short period of time (more than one hour), the tenderers may determine whether to terminate the evaluation of bid according to law and regulations. At the same time, the tenderers shall cooperate with the transaction service agencies to seal up and keep confidential the bidding data, and re-establish the evaluation of bid committee to conduct the evaluation of bid after the failure is resolved.

Article 29 After the evaluation of bid begins, if the evaluation of bid cannot be continued due to power failure, network failure, malfunction of electronic equipment, or malfunction of the system of electronic evaluation of bid at the main fields, the bidding can be cancelled within a short period of time (no more than one hour), and the evaluation of bid will continue after the failure is resolved. If the failure cannot be resolved within a short period of time (more than one hour), the tenderers may terminate the evaluation of bid according to law, seal up and keep confidential the bidding data, and re-establish an evaluation of bid committee to conduct the evaluation of bid after the failure is resolved.  Article 30 After the bid evaluation begins, if the evaluation of bid cannot be continued due to power failure, network failure, malfunction of electronic equipment, or malfunction of the system of electronic evaluation of bid at the auxiliary fields, the failure can be resolved within a short period of time (no more than one hour), and the evaluation of bid will continue after the failure is resolved. If the failure cannot be resolved within a short period of time (more than one hour), notify the main fields, and with the approval of the administrative supervision and management departments, the main fields will supplement and extract experts to replace the auxiliary fields for evaluation of bid. The experts of auxiliary fields must wait until the main fields end the evaluation of bid before leaving the fields. 

Chapter 7 Legal Responsibility

Article 31 The main fields are responsible for providing a platform and technical support for remote different-place evaluation of bid activities. 

Article 32 If the administrative supervision and management departments, trading service agencies and their staff members of the main and auxiliary fields disclose to others the public resources trading information that should be kept confidential according to law, the relevant government departments shall order it to make corrections within a time limit and give it to informed criticism. If the circumstances are serious, the person directly responsible and the relevant leaders shall be investigated for responsibility according to law. If a crime is constituted, criminal responsibility shall be investigated according to law. 

Article 33 No unit or individual may engage in illegal and criminal activities, for example, endanger national interests and information security by remote different-place evaluation of bid. The legal responsibilities of the parties and acts endangering the safe and normal operation of the platform systems shall be investigated according to law.

Chapter VIII Supplementary Provisions

Article 34 These Measures shall be explained by Dalian Public Resources Trading Management Office. 

Article 35 These Measures shall come into force since January 1, 2019.
